TERMS OF SERVICE AGREEMENT	I. Acceptance of Terms of Use Bombthreats.com's Affiliate service is provided free of charge to registered users (each, a "User") under these Terms of Use. BY COMPLETING THE REGISTRATION PROCESS AND CLICKING THE "I Agree" LINK, YOU ARE INDICATING YOUR AGREEMENT TO BE BOUND BY THESE TERMS OF USE. These Terms of Use form independent agreements between you and Bombthreats.com, as each Term applies to Bombthreats.com. II. Registration Information User understands that Bombthreats.com will not disclose to third parties information contained in Users' registration applications. Modifications of these Terms of Use Bombthreats.com may modify these Terms of Use from time to time in its sole discretion. When possible, Bombthreats.com will provide Users with reasonable notice of any such changes, however we are under no obligation to do so. Continued use after such notice from Bombthreats.com will constitute acceptance of any such changes. IV. Modifications of Bombthreats.com Bombthreats.com may modify or discontinue User's account with or without notice to any User, without liability to any User or any third party. V. Contents of Messages Bombthreats.com does not, and cannot, monitor, censor or edit the contents of Users' email messages. Users alone are responsible for the contents of their messages, and the consequences of any such messages. User agrees that it will not use Bombthreats.com for chain letters, junk mail, "spamming", solicitations (commercial or non-commercial) or any use of distribution lists to any person who has not given specific permission to be included in such a process. User further agrees not to use Bombthreats.com to send any messages or material that are unlawful, harassing, libelous, abusive, threatening, harmful, vulgar, obscene or otherwise objectionable or illegal material of any kind or nature. Bombthreats.com reserves the right to terminate any User's account without notice if it becomes aware and determines, in its sole discretion, that such User is violating any of the foregoing guidelines. It is Bombthreats.com's policy to respect the privacy of its Users, but User agrees that this Agreement does not create a reasonable expectation of privacy in the context of User's email communications. VI. Account and Password User is responsible for maintaining the confidentiality of its user id and password. User shall be responsible for all uses of its account, whether or not authorized by User. User agrees to immediately notify Bombthreats.com of any unauthorized use of its account. VII. IX. Email Message Storage Bombthreats.com will not assume any responsibility for the deletion or failure to store email messages, whether inadvertent or through Bombthreats.com's negligence. X. Indemnification User agrees to defend, indemnify and hold Bombthreats.com, its parents, subsidiaries, affiliates, officers and employees, harmless from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of User's use of Bombthreats.com, the violation of these Terms of Use by User, or the infringement by User, or any other user of User's account, of any intellectual property or other right of any person or entity. XI. Applicable Law These Terms of Use shall be governed by and construed in accordance with the laws of the State of Maine, without giving effect to its conflict of laws provisions. XII. Network Abuse Anyone who uses Bombthreats.com's server in a way deemed improper by Bombthreats.com will be punished to the full extent of the law. (i.e. mass e-mail of unsolicited e-mail, flooding, e-mail bombs, etc...). Bombthreats.com pledges to fully comply with law enforcement officials in any way required. Furthermore, many individual states have instated fines against such actions, for example unsolicited email received in Nevada carries a $.10 fine per email.
